1. Acceptance of Terms
By placing an order for web design services through this website or via direct invoice, you confirm that you have read, understood, and agreed to these Terms and Conditions, as well as our Privacy Policy, Refund Policy, and Shipping & Delivery Policy.
2. Scope of Web Design Services
We specialize exclusively in web design services, including layout creation, user interface (UI) design, and visual structuring. The specific details, deliverables, and revision limits of your project are defined by the web design package you select (Starter, Standard, or Premium) at the time of purchase. Any additional design requirements outside the chosen package will be billed separately.
3. Client Responsibilities
To ensure a smooth design process and timely delivery, the client agrees to:
- Provide all necessary text, images, branding guidelines, and other project assets in a timely manner.
- Respond to design drafts and revision requests promptly. Delays in client feedback will result in corresponding delays to the project’s final delivery date.
- Ensure that any materials provided to us do not infringe upon the copyrights or intellectual property rights of any third party.
4. Payments and Billing
- Payment Gateway: All payments are processed securely via Razorpay.
- Milestones: Depending on the selected package, a non-refundable upfront deposit (e.g., 50%) may be required before design work commences. The final balance is due before the handover of the final design files.
- Late Payments: Failure to pay the final balance upon project completion may result in the withholding of final digital deliverables.
5. Intellectual Property and Copyright
- Ownership Transfer: Upon receipt of full and final payment, all rights, title, and interest in the final visual web design deliverables will be transferred to the client.
- Portfolio Rights: Nong Own Emphum retains the right to display the completed website designs, mockups, and layouts in our professional portfolio and on social media for promotional purposes, unless a non-disclosure agreement (NDA) is explicitly signed beforehand.
6. Revisions and Approvals
Each design package includes a set number of revisions. A “revision” constitutes minor adjustments to the presented layout or typography, not a complete redesign of the approved concept. Once the final design is formally approved by the client, any further changes will be subject to additional hourly or per-page billing.
7. Limitation of Liability
Nong Own Emphum shall not be held liable for any indirect, incidental, or consequential damages, including loss of profits, revenue, or data, arising out of or related to the use of our web design services. Our maximum liability to you for any claim arising from a project shall not exceed the total amount paid by you for that specific service.
8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Arunachal Pradesh, India.
